General Terms and Conditions of Sale

Article 1 – Seller Identity
The website operated under the MyPrime™ brand (hereinafter referred to as the “Site”) is published and operated by:

Hereinafter referred to as the “Seller” or “MyPrime™”.
The Site is operated using the Shopify platform.
Article 2 – Purpose and Scope
These General Terms and Conditions of Sale, hereinafter referred to as the “Terms”, govern the sale of products on the Site between the Seller and any individual acting for purposes outside their trade, business, craft or profession, hereinafter referred to as the “Customer”.
These Terms define, in particular, the conditions relating to:
- products;
- prices;
- orders;
- payments;
- deliveries;
- the right of withdrawal;
- returns;
- warranties;
- dispute resolution.
Any order placed on the Site implies acceptance of these Terms.
The applicable Terms are those in force at the time the order is placed.
The Seller may amend these Terms at any time. Any subsequent amendment shall have no effect on an order that has already been concluded.
Article 3 – Products
The products offered for sale are those presented on the Site at the time it is accessed by the Customer, subject to availability.
The Seller endeavors to present the essential characteristics of each product clearly and accurately.
Photographs, videos, illustrations and product demonstrations are provided for illustrative purposes. Slight differences in color or appearance may result, in particular, from lighting, photography or the screen used by the Customer.
MyPrime™ sells, among other things, support, stabilization and comfort accessories designed to assist with everyday movement or physical activities.
Unless expressly stated otherwise, the products are not medical devices intended to establish a medical diagnosis or replace medical treatment or the recommendations of a healthcare professional.
In the event of persistent pain, injury or a health condition, the Customer is advised to seek advice from a healthcare professional.
Article 4 – Prices
The applicable prices are those displayed on the Site at the time the order is confirmed.
Prices are displayed in the currency offered to the Customer according to their market or location.
Where the Seller is subject to the French VAT exemption scheme, VAT is not charged in accordance with Article 293 B of the French General Tax Code.
Any applicable shipping charges are indicated before the order is finally confirmed.
The total amount payable by the Customer is displayed before payment.
The Seller reserves the right to change its prices at any time. However, such changes do not apply to orders that have already been confirmed.
In the event of an obvious pricing error resulting, in particular, from a technical malfunction, the Seller may contact the Customer to offer them the option of confirming the order at the correct price or cancelling it with a full refund.
Article 5 – Orders
The Customer selects the products they wish to purchase and adds them to their cart.
Before final confirmation, the Customer may check, in particular:
- the products selected;
- the selected variants;
- quantities;
- the price;
- any applicable shipping charges;
- their delivery address.
The Customer may correct any errors before confirming the purchase.
Final confirmation of the order creates an obligation to pay.
After payment has been confirmed, the Customer receives an email summarizing the main details of the order.
The Customer agrees to provide accurate and complete information necessary to process the order.
The Seller may refuse or cancel an order, in particular, in the event of:
- payment being declined;
- reasonable suspicion of fraud;
- product unavailability;
- an obvious error;
- a previous dispute relating to the payment of an order.
Where an order that has already been paid for is cancelled by the Seller, the amounts due are refunded.
Article 6 – Payment
Payment is made online at the time the order is placed.
Depending on the options available during checkout, the Customer may in particular pay using:
- Visa;
- Mastercard;
- Shop Pay;
- Apple Pay;
- PayPal.
The payment methods actually available are those displayed at checkout.
Payments are processed by specialized and secure payment service providers.
The Seller does not have access to the Customer’s full payment card number.
The order is only definitively accepted after payment has been confirmed.
In the event of payment being declined or a payment incident, the order may be suspended or cancelled.
Article 7 – Order Preparation and Shipment
Once payment has been confirmed, orders are generally prepared and shipped within:
1 to 3 business days.
This period corresponds to the preparation of the order before it is handed over to the carrier.
Once the order has been shipped, a tracking number or tracking link may be provided to the Customer where tracking is available.
Article 8 – Delivery
Products are delivered to the address provided by the Customer when placing the order.
After shipment, the delivery times generally indicated are:
France: 4 to 10 days
European countries served: 6 to 12 days
United States: 5 to 12 days
These timeframes are estimates.
Taking into account the preparation time of 1 to 3 business days, the estimated total delivery time may therefore be approximately:
France: 5 to 13 days
Europe: 7 to 15 days
United States: 6 to 15 days
The contractually applicable delivery timeframe remains the one communicated to the Customer before the order is concluded.
The Customer is responsible for the accuracy of the delivery address and information they provide.
If an error is identified after the order has been placed, the Customer must promptly contact:
MyPrime™ will make every reasonable effort to make the requested change if the order has not yet been shipped, but cannot guarantee that a change will be possible once the order is being processed.
Delivery Delays
In the event of a delay, the rights granted to consumers under the French Consumer Code remain fully applicable.
Where the legal requirements are met, the Customer may, in particular, formally request that the Seller deliver the order within a reasonable additional period and, if the Seller fails to do so, terminate the contract.
Any sums due following such termination shall be refunded within the applicable statutory time limits.
Transfer of Risk
Where the carrier is offered by the Seller, the risk of loss or damage to the product transfers to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the product.
Article 9 – Customs and Deliveries Outside the European Union
For orders delivered outside the European Union, including to the United States, customs duties, import taxes or other charges may potentially be imposed by the authorities of the destination country.
MyPrime™ covers any such customs duties and import taxes relating to the delivery of the order.
The Customer is therefore not expected to pay additional customs or import charges upon receipt of the package.
If, despite this, customs duties or import taxes are requested from the Customer upon delivery, the Customer is invited to contact MyPrime™ at contact@myprime.fr and provide the relevant supporting documentation so that the situation can be reviewed and, where appropriate, reimbursed.
Article 10 – Statutory Right of Withdrawal
Customers who qualify as consumers under the rules governing distance-selling withdrawal rights in the European Union have 14 days to exercise their right of withdrawal without having to provide a reason.
For the sale of a product, this period begins on the date on which the Customer, or a third party designated by the Customer other than the carrier, receives the goods.
Where several products from the same order are delivered separately, the period begins on the date the last relevant product is received.
To exercise the right of withdrawal, the Customer may send a clear statement to:

Use of the form is not mandatory.
After informing the Seller of their decision to withdraw, the Customer must return the product no later than 14 daysthereafter.
The direct cost of returning the goods is borne by the Customer, unless otherwise provided by law or unless MyPrime™ expressly agrees to cover such costs.
The Customer may handle the product to the extent necessary to establish its nature, characteristics and proper functioning.
The Customer may be held liable for any reduction in value resulting from handling beyond what is necessary for this purpose.
Article 11 – Refund Following Withdrawal
Where the Customer validly exercises their statutory right of withdrawal, MyPrime™ will refund the amounts due no later than 14 days from the date on which the Seller is informed of the Customer’s decision to withdraw.
However, the Seller may delay the refund until:
- the product has been recovered; or
- proof that the product has been shipped has been received,
whichever occurs first.
The refund will be made using the same payment method used for the order, unless the Customer expressly agrees to another method that does not result in any additional costs.
The statutory refund includes the standard delivery charges originally paid.
Where the Customer selected a delivery method that was more expensive than the standard delivery method offered, the additional cost does not have to be refunded.
Article 12 – MyPrime™ 30-Day Commercial Return Guarantee
Independently of the statutory right of withdrawal and statutory warranties, MyPrime™ offers a 30-day commercial return guarantee starting from the date the product is received.
Under this guarantee, the Customer may request the return of a product that is not suitable for them.
The request must be sent to:
To benefit from this commercial guarantee, particularly after the statutory withdrawal period has expired, the product must be returned:
- complete;
- clean;
- undamaged;
- with any accessories supplied;
- and, where possible, in its original packaging.
Products purchased as part of a promotion are also covered by this guarantee unless otherwise clearly stated to the Customer before purchase.
Unless otherwise required by law, return shipping costs are borne by the Customer.
For returns made solely under the 30-day commercial guarantee after the statutory withdrawal period has expired, the refund covers the price of the returned product. Original shipping charges are refunded only where required by law or where MyPrime™ expressly agrees to refund them.
The 30-day commercial guarantee is separate from statutory warranties and does not reduce any rights available to the consumer.
Article 13 – Standard Withdrawal Form

Article 14 – Defective, Damaged or Non-Compliant Product
The Customer is encouraged to check their order as soon as it is received.
If the product is:
- damaged;
- defective;
- different from the product ordered;
- incomplete;
- or affected by a lack of conformity,
the Customer may contact MyPrime™ at:
The Customer is encouraged to provide their order number and, where useful, photographs of the product or package.
The Customer’s rights under statutory warranties remain applicable independently of this procedure.
Where the seller is legally required to cover the return of a non-compliant product, the necessary return costs shall not be borne by the consumer.
Article 15 – Statutory Warranties
The Seller is liable under the statutory guarantee of conformity and the statutory warranty against hidden defects.

Terms and conditions governing the sale of goods must include the statutory notice relating to legal warranties.
Statutory Guarantee of Conformity
The consumer has a period of two years from the delivery of the goods to invoke the statutory guarantee of conformity in the event that a lack of conformity appears.
During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it arose.
The statutory guarantee of conformity entitles the consumer, in particular and subject to the conditions provided by law, to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience.
If the goods are repaired under this guarantee, the consumer benefits from a six-month extension of the original guarantee.
If the consumer requests repair but the seller requires replacement, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement.
Where the legal requirements are met, the consumer may also obtain a reduction in price or termination of the contract.
Detailed provisions are set out in Articles L. 217-1 et seq. of the French Consumer Code.
Warranty Against Hidden Defects
The consumer also benefits from the statutory warranty against hidden defects provided for by Articles 1641 et seq. of the French Civil Code.
This warranty may be invoked where a hidden defect makes the product unfit for its intended purpose or reduces its usefulness to such an extent that the Customer would not have purchased it, or would have paid a lower price for it, had they known of the defect.
An action relating to hidden defects may be brought within two years from the discovery of the defect.
Subject to the conditions provided by law, the Customer may, in particular, obtain a price reduction or return the product in order to obtain a refund of the purchase price.
Article 16 – Exchanges
Where a Customer wishes, in particular, to change the color or replace a product, they may contact:

MyPrime™ will inform the Customer whether a direct exchange is possible.
If the Customer wishes to receive the new item more quickly, they may also place a new order and request the return of the first product in accordance with the applicable conditions.
Article 17 – Cancellation Before Shipment
A Customer wishing to cancel an order before shipment must contact MyPrime™ as soon as possible at:
Where cancellation is still technically possible, the Seller will cancel and refund the order.
If the order has already been shipped, the Customer may use the applicable return or withdrawal procedures.
This provision does not limit the consumer’s statutory rights.
Article 18 – Liability
The Seller is responsible for fulfilling its obligations in accordance with applicable law.
However, the Seller shall not be held liable where non-performance results, in particular, from:
- an act or fault attributable to the Customer;
- use that is clearly contrary to the product’s intended purpose;
- or an event of force majeure within the meaning of French law,
to the extent permitted by law.
Nothing in these Terms may exclude or limit any warranty or liability that applicable law does not permit to be excluded or limited.
Article 19 – Personal Data
The Customer’s personal data is processed in accordance with the Privacy Policy available on the Site.
It may, in particular, be used to:
- process orders;
- process payments;
- arrange delivery;
- manage customer service;
- manage returns and refunds;
- comply with accounting and legal obligations.
The Customer has the rights provided for under applicable data protection regulations.

Article 20 – Intellectual Property
The elements available on the Site, including texts, photographs, images, videos, graphics, logos, layout elements and distinctive signs, may be protected by intellectual property laws.
Any unauthorized reproduction, representation, distribution, adaptation or use of all or part of the Site is prohibited, except where permitted by law or with the prior authorization of the relevant rights holder.
Article 21 – Consumer Mediation
After submitting a written complaint to MyPrime™ and if the dispute has not been satisfactorily resolved, the consumer Customer may use the services of the consumer mediator appointed for the Seller free of charge.

A request may, in particular, be submitted using the form available on the mediator’s website.
Mediation is free of charge for the consumer. The costs of the mediation procedure are borne by the professional, subject to any costs personally incurred by the consumer in obtaining assistance or advice.
The agreement you received states, in particular, that mediation may only be used after an attempt has first been made to resolve the dispute directly with the professional. It also provides that, in principle, a request must be submitted within one year following the consumer’s written complaint.
MyPrime™ has appointed Société Médiation Professionnelle as the mediator for its distance-selling activities.
Article 22 – Applicable Law
These Terms are governed by French law.
Where the Customer is a consumer residing in another country, the application of French law does not deprive the Customer of any mandatory consumer protection provisions available to them under the law applicable in their place of residence where such provisions apply.
Article 23 – Disputes
In the event of any difficulty relating to an order or the application of these Terms, the Customer is encouraged to contact MyPrime™ first at:

The mediation procedure referred to in the preceding Article remains available where the applicable conditions are met.
If no amicable settlement is reached, the consumer may bring the matter before the competent court in accordance with the applicable legal rules.
Nothing in these Terms may deprive a consumer of the right to bring proceedings before a court where such a right is granted by law.
